An omnibus hearing last Tuesday in Cottonwood County District Court raised challenges of probable cause by the defense on charges of second-degree murder and first-degree burglary.
Jamie Voelker of Windom was charged with second-degree murder (with intent, not premeditated), second-degree murder (without intent, while committing a felony) and first-degree burglary (occupied dwelling with a non-accomplice present) following a July 23 incident that resulted in the death of his mother, 70-year-old Kathryn Voelker.
At the hearing, defense attorney John Barragry challenged whether there was probable cause to arrest Voelker on all three charges.
Briefs on the matter are due from the state on Dec. 18, while the defense’s brief is due Jan. 9. After that, Judge Christina Wietzema will have 30 days to issue a ruling.
More on this story appears in the Dec. 3 print and e-editions of the Citizen.
