Eric Jon Miller, 33, of Windom, has been charged in Cottonwood County Court with four counts of possession of pornographic material involving a minor, and one count of fifth-degree criminal sexual conduct.
According to the criminal complaint, the Bureau of Criminal Apprehension received a cybertip regarding a Snapchat account, found to be used by Miller. A search warrant reviewed media files, finding four images of pornographic work depicting sexual conduct involving minors.
Law enforcement interviewed Miller July 25, 2024, with Miller reportedly admitting to sending the images in the cybertip. He admitted obtaining the photos from other apps and distributing them.
On April 1, a deputy was informed of a possible sexual assault of a vulnerable adult. The victim stated she had met Miller on a Facebook dating site and they started talking.
In December, 2024, he had met with the victim and asked for oral sex, with the victim saying no. She stated Miller then held her head down and forced her to perform oral sex on him. She told the interviewer she since blocked him on social media and does not talk to him anymore.
A deputy interviewed Miller, who claimed the victim did not say no and contact was consensual.
Miller is required to register as a predatory offender for a prior conviction for possession of pornography involving a minor.
If convicted, each of the four counts of possession of child pornography carries a maximum possible sentence of 10 years in prison and/or a $10,000 fine. If convicted, the fifth-degree criminal sexual conduct charge carries a maximum possible sentence of seven years in prison and/or a $14,000 fine.
