A 19-year-old Windom man, Isaiah Elijah Thomas Eagle, has been charged with second-degree assault with a dangerous weapon, a felony, and fifth-degree assault, a misdemeanor, following an incident which allegedly occurred on Jan. 11.
According to the police complaint, on Feb. 3, Windom police officers spoke to two individuals regarding ongoing issues they had been having with Eagle, including making alleged threats to their daughter. They also stated that Eagle had assaulted a juvenile.
In a video that Windom police reviewed of the assault, Eagle can be seen punching the victim, pulling his hair and spitting on him. The witness also stated that he had pointed a rifle at the victim.
The report stated that police then spoke with the victim, saying he was at Eagle’s residency on Jan. 11, around 11-11:30 p.m., when he pointed the gun at his face, made a comment that he was going to shoot him and then cocked the rifle back. He then smacked the rifle out of Eagle’s hand and started punching him.
The complaint states that officers then obtained a search warrant for Eagle’s residence. During the search, officers found a BB gun and 12-gauge shotgun shells. There was also an empty box for a 12-guage shotgun and choke tubes. Officers were unable to locate the shotgun, however. Also found were 77 THC vape cartridges and a large amount of cash, that was scattered around the residency.
Eagle later told Windom police that the victim has tried to hit him and he hit the victim back. He also admitted to slapping, hitting and pulling the victim’s hair. He did, however, deny having a firearm or BB gun, according to the report.
The maximum sentence for second-degree assault with a dangerous weapon is seven years in prison with a $14,000 fine. The charge does carry a mandatory minimum sentence of one-year and one-day in prison.
The maximum sentence for the fifth-degree assault is 90-days in jail and a $1,000 fine.
