The Minnesota Supreme Court on Wednesday ruled that even when a person is under attack they can’t brandish a deadly weapon if it is “reasonably possible to retreat.”
The decision stems from a June, 2021 knife/machete altercation near the light rail station by U.S. Bank Stadium in Minneapolis.
In a dissent, Justice Paul Thissen called this unprecedented and said, “As far as I am aware, the rule has never been adopted anywhere in the United States.”
He called for the case to be retried and rethought.
